Communicable Disease Exclusion
Please note that the Public/Products Liability segment of the policy now incorporates the following exclusion:
The indemnity granted by this policy shall not apply to any loss, damage, liability, claim, cost, or expense of whatsoever nature, directly or indirectly caused by, contributed to by, resulting from, arising out of, or in connection with, the following:
- A communicable disease; or
- The fear or threat (whether actual or perceived) of a communicable disease regardless of any other cause or event contributing concurrently or in any other sequence thereto.
For the purpose of this exclusion, ‘communicable disease’ means any disease which can be transmitted by means of any substance or agent from any organism to another organism where:
- The substance or agent includes, but is not limited to, a virus, bacterium, parasite, or other organism or any variation thereof, whether deemed living or not.
- The method of transmission, whether direct or indirect, includes but is not limited to airborne transmission, bodily fluid transmission, transmission from or to any surface or object, solid, liquid, or gas or between organisms.
- The disease, substance, or agent can cause or threaten damage to human health or human welfare or can cause or threaten damage to, deterioration of, loss of value of, marketability of, or loss of use of property.
This exclusion does not apply to:
- Food or drink poisoning
- Legionnaires’ disease (if specifically covered by an extension or endorsement applied to this policy but only to the extent of cover expressly stated as being provided under the extension or endorsement)
Demands and Needs Statement
The purpose of this statement is to set out your insurance Demands & Needs and the reasons why we have recommended the policy to you. On the basis that you are a Dance Teacher, it is our opinion that you require cover to protect you against the following risks:
- Public & Products Liability
- Professional Indemnity
- Personal Accident
Special Requirements
Whilst the Policy offers a wide cover, it does not include cover for any equipment or Employers Liability Insurance. If either of these covers are required, we would ask you to contact us. In addition, please note our comments under the next heading.
The Limits of Indemnity: "Public/Products Liability"
It is our advice that you give very strong consideration to increasing the Limits of Indemnity under your Public/Products Liability. Currently, the Limit of Indemnity is £5,000,000 any one incident/unlimited during the period of insurance in respect of Public Liability and any one incident/in the aggregate during the period of insurance in respect of Products Liability.
The reason for this advice is because the UK Government has recently amended the Ogden rate. This has remained unaltered since 2001, during which time there has been a significant reduction in interest rates. The Ogden rate is used to calculate future losses in personal injury and fatal accident cases. The Government changed the rate initially from +2.5% to -0.75% & again in the summer of 2019 to -0.25%.
As an example, one Insurer has shown that a serious injury to a 30-year-old man earning £25,000 per year would have resulted in a claim of £2.8m for future loss of earnings and ongoing care based on a rate of +2.5%. The amendment to -0.75% meant that the total claim would have been £6.3m. Although the rate of -0.75% is no longer applicable, it is clear that even with a rate of -0.25%, the Limits of Indemnity for Employers & Public Liability need to be carefully reviewed. In the circumstances, therefore, please let us know if you would like a quotation to increase your limits of indemnity.
